Re: EPA Update
On January 19, 2018, the EPA filed a Supplemental Status Report in relation to an active lawsuit in the US Court of Appeals.  The supplemental information discusses the EPA’s intent to complete the Clean Air Act requirement of finalizing designations for compliance with the 2015 National Ambient Air Quality Standards (NAAQS) for ozone.  The submitted supplement states:

“EPA intends to finalize all pending ozone designations by April 30, 2018, except for the eight counties comprising the San Antonio, Texas area.  EPA intends to finalize the designation for the eight counties comprising the San Antonio area by August 10, 2018.”

The reason for the San Antonio area delay is to allow the Governor the opportunity to submit additional data and considerations that warrant an attainment or unclassifiable/attainment designation.   As a result, the EPA has issued a deadline of February 28, 2018 for the State to provide any additional information to be considered in the EPA’s final assessment for the San Antonio area’s designation.  After this date, the EPA will review any information provided and issue its intended designation for our region by April 12, 2018.  The EPA decision as of this date will be provided as a 120-day letter that will be effective as of August 10, 2018.
